Article 1 – Definitions

• Customer: Any adult individual capable of contracting and recognized as a consumer as per the Consumer Code, purchasing Products for non-professional purposes on the Website.
• General Terms and Conditions of Sale or GTCS: The terms governing the use of the Website and the sale of Products, which the Customer accepts when ordering.
• Le Domaine US Inc : Le Domaine, a limited liability company with a capital of 50,000 euros, registered in Aix en Provence, headquartered at 68 3rd Street
• Brooklyn NY 11231, represented by President Marc Perrin, EIN 92-2750238, operating the Website.
• Product: Any item offered for sale on the Website, especially cosmetics.
• Website: us.beau-domaine.com, owned and operated by Le Domaine US inc, hosted by Shopify Corporation.

Article 2 – Purpose and Application of the General Terms and Conditions of Sale These GTCS define the rights and obligations of Le Domaine Skincare and the Customer for the sale of Products. The Customer accepts these terms when ordering Products on the Website by checking the corresponding box. These GTCS are permanently accessible on the Website, allowing the Customer to print and/or download them. Le Domaine reserves the right to modify these terms, with the applicable GTCS being those accepted by the Customer at the time of the order.

Article 3 – Product Orders on us.beau-domaine.com Products are intended for individual sale. Organizations must contact Le Domaine directly.

• Creating an Account: Ordering does not require creating an account. The Customer must provide accurate information. The account will be accessible using the login credentials chosen during registration. The Customer's credentials are personal and confidential.
• Product Selection: The Customer selects Products by adding them to the cart. The characteristics of the Products are detailed on the Website.
• Placing an Order: The Customer can finalize the order by clicking "Order" in the cart, providing necessary information, and selecting a payment method. The order becomes final after payment. Le Domaine reserves the right to cancel orders in case of disputes or for orders that do not correspond to retail sales.
• Product Availability: Orders are honored within stock limits. In case of unavailability, the Customer is informed within 48 hours, and partial orders can be delivered in multiple shipments at no extra cost.

Article 4 – Price and Payment

• Price: Product prices are displayed in USD$, including taxes. Delivery charges are additional. Prices can change at any time, with the applicable price being the one on the order day. The price is payable upon order placement via secure payment methods.
• Customer Warranty: The Customer guarantees they are authorized to use the payment method and have sufficient funds. Le Domaine is not responsible for fraudulent payment use.

Article 5 – Delivery Products are delivered only to addresses in specified countries. An order can be associated with only one postal address.

• Delivery Time: 2-5 days. Hard-to-reach areas may have additional delays.
• Tracking and Delays: Orders can be tracked via email or by contacting service@beau-domaine.com. Delays beyond indicative times may result in sale cancellation by registered letter.

Article 6 – Cancellations and Returns Customers have 14 days to withdraw from the purchase and return Products at their expense. Returns should be in the original unopened packaging.

• Return Address: 68 3rd Street Brooklyn NY 1123. Le Domaine will refund the Customer within 14 days of receipt of the returned Products or proof of shipment.

Article 7 – Warranties Products conform to current laws and standards. Warranties exclude non-compliance due to abnormal use or modification. Defective Products should be returned to: 68 3rd Street Brooklyn NY 11231

Article 8 – Liability Le Domaine is not responsible for Internet issues or if the Product characteristics differ slightly from the website images. Liability is limited to direct damages. Hyperlinks on the Website are the Customer's responsibility.

Article 9 – Intellectual Property The Website and all elements (trademarks, logos, etc.) are the property of Le Domaine or rights holders. Reproduction or use is allowed only for personal, non-commercial purposes.

Article 10 – Applicable Law and Disputes The sales contract is concluded in French and governed by French law. Disputes may be resolved through claims, mediation, or legal action, with the Customer able to choose the jurisdiction.

Article 11 – Miscellaneous Provisions If any non-essential GTCS clause is void or unenforceable, the remaining provisions remain unaffected. Failure to enforce any provision does not constitute a waiver.
